The City of Cortland Planning, Zoning & Building Commission met on Monday, November 12, 2012 at 6:45 P. M. at the City Administration Building, 400 N. High Street, Cortland, Ohio. In attendance were the following board members: Chairman Scott Daffron, Sally Lane, Charles Peck, and Jim Chubb. Scott Daffron: Today is Monday, November 12, 2012.I would like to call to order the Cortland Planning, Zoning and Building Commission for the purpose of public hearing 25-12, Public Hearing for Zone Change Request for 212 N High Street which is the old library.It is a request to change from residential to Highway Commercial District.Who do we have to speak on behalf of this zone change request?

 

Michael McGee: Good evening, everyone.My name is Michael McGee.I am a member of the Board of Trustees of the Warren Trumbull County Public Library and we are here in furtherance of our application for zoning change for the old Cortland library building at 212 N High Street.†† As everyone knows Iím sure we built a new library in another neighborhood here in Cortland.The old building is currently vacant.We are asking for a zoning change to make the building more marketable for us to put up for sale.Do you have any questions?I believe you have a copy of the application there.

 

Scott Daffron:Yes, we have that.Don, your opinion for Highway Commercial District as an appropriate zone class for that location?

 

Don Wittman:Yes.

 

Scott Daffron:Do we have any other questions?

 

James Chubb:In my opinion, you are not going to put any residents in there in the first place.It is a beautiful building and I donít think we are going to have anyone selling bed mattresses.

 

Michael McGee:We think this building is likely going to be purchased by someone who wants to put offices in there like an accounting firm or something of that nature.

 

Scott Daffron:Since there are no other questions, I would like to ask if there is anyone else in the audience to speak for the zone change request.Is there anybody who would like to speak against the zone change request?Seeing none, can I have a motion to close public hearing 25-12?

 

Charles Peck: so moved.James Chubb: second.

 

Scott Daffron:The actual zone change request will be voted on at the regular meeting.We will start the regular meeting at 7:00 p.m.

Scott Daffron:Can I have a motion for approval of commission minutes for October 8, 2012?

 

Sally Lane made a motion to approve October 8th, 2012 Regular Meeting minutes, seconded by Jim Chubb.

Scott Daffron:No old business on our agenda, moving on to new business:Can I have a motion for approval of 25-12 Zone Change Request for 212 N High Street, the old library from residential to C-2, Highway Commercial District.Charles Peck made a motion for approval of 25-12, seconded by James Chubb.

 

Scott Daffron:Do I have any further comments or questions?

 

Scott Daffron:Seeing none, can we have a vote on 25-12?

Scott Daffron:That approves your zone change request, which will now go to Council.

 

Scott Daffron: Next on the agenda, can I have a motion for approval of 26-12 Ė Set Time and Date for Public Hearing for Variance Request for 677 S High Street.Variance request is to allow a commercial addition to encroach on the forty (40) foot front set back by 10 feet.Set for December 10th at 6:45 p.m.

Charles Peck made a motion for approval of 26-12, seconded by Sally Lane.

 

Don Wittman:Not discussion but a comment:I wanted to apologize for revising the agenda a few days before this meeting however we were approached by the owners of the veterinary clinic in the process of doing demolition because of a vehicle driving through their front door.So I felt it was appropriate to bring it before this board since we are just setting a public hearing and we can save them a month so they can get started in December as opposed to January.Typically we want to have things in 7 days before the meeting to set the agenda.

 

Scott Daffron:Do they have to excavate the hillside on the backside for this?

 

Mayor Moll:No this is on the front where the truck went through the building.They want to build out from there and it is too close to the road.It is only 5 feet more.

 

Scott Daffron: Can we have a vote on 26-12?

Scott Daffron:Do we have any further comments?

 

Don Wittman:I want to apprise this board of a little project that Terri and the Clerk of Council have been working on as far as doing an inventory of all of the parcels in the city and comparing the zoning to the actual use so that we can recommend some changes to this board.Some of the glaring ones are the Highlands Ridge Development which was developed in 1995 under Industrial Zoning.At that time you could build single family residential in industrial and that has never been changed.And like what is before us this evening as far as highway commercial district through the major thoroughfares which would allow a mixed use of light commercial and residential which is what North and South High Street should be instead of the heavier Service District.As homes are being used as commercial one year and residential the next, technically that shouldnít happen.Once it is converted they lose the use of being residential.So, there are going to be some recommendations that come out of that Ė glaring fixes as well as more appropriate zoning classifications which were adopted in 1996.

 

Mayor Moll:And we have zero setback and zero clearance in downtown areas that are all zoned service which doesnít allow that kind of construction.Downtown commercial would.There are a number of things you could look at that was never cleaned up when the original zoning was passed.

 

Scott Daffron:One time we looked at that.

 

Mayor Moll:Yes we talked about it before but just never had the resources to do it, but now we do, so we are going to try to make a run at it.There are still some legal questions on how you approach a mass zone change and how many public hearings you have to have and how that is put together but we will work that out.

 

Don Wittman:So any input or any comments would be appreciated as far as specific properties or even general or if we should have work session with some members of Council and members of Planning and Zoning so that we are working together towards a common goal.

 

Scott Daffron:Donít we have already have a map of land use?

 

Mayor Moll:It is not very up to date.

 

Don Wittman:That is the other thing, the map is 10 years old.We need to update the map, while we are doing this. We can update the map and make the zoning correct.As the property has a zoning change we have a table.You have to go to your map and then go the table and verify that is not on the list.

 

Scott Daffron:No it needs to be done and is definitely a good thing to take care of.

 

Charles Peck:I totally agree and think that would be a good winter project for us to spend some time on.

 

Mayor Moll:The other thing we donít have is a general land use plan for the city like these areas should be residential and these areas should be commercial and this is the kind of commercial we should have in those areas.†† We just donít have that put together and that needs to be done.

 

Scott Daffron: If no one has anything else can we entertain a motion to adjourn?

 

Sally Lane made a motion to adjourn the meeting, seconded by Charles Peck.
